Cette forme de partenariat a conduit \u00e0 la r\u00e9alisation de plusieurs projets r\u00e9cents dont l\u2019autoroute \u00e0 P\u00e9age Ila-Touba, le Train Express R\u00e9gional (TER) et la cit\u00e9 Minist\u00e9rielle\u00a0\u2026 Les PPP permettent aux Etats de r\u00e9aliser les projets n\u00e9cessaires \u00e0 leur d\u00e9veloppement et \u00e0 l\u2019am\u00e9lioration des conditions de vie de leurs populations.<\/em><\/strong><\/p>\r\n\r\n<p>Le S\u00e9n\u00e9gal, conscient desdits enjeux, a mis en place en 2014 un nouveau cadre r\u00e9glementaire et institutionnel favorisant la r\u00e9alisation des partenariats public-priv\u00e9 tels que connus \u00e0 ce jour avec d\u2019importants investisseurs internationaux.<\/p>\r\n\r\n<p>Si la loi n\u00b02014-09 du 20 f\u00e9vrier 2014 relative aux contrats de partenariat exclut certains secteurs d\u2019activit\u00e9s comme ceux de l\u2019\u00e9nergie, des mines et des t\u00e9l\u00e9communications, qui rel\u00e8vent de r\u00e9glementations sp\u00e9cifiques,\u00a0elle s\u2019applique \u00e0 des secteurs vari\u00e9s tels que les transports, l\u2019agriculture, l\u2019\u00e9ducation, la sant\u00e9, etc.<\/p>\r\n\r\n<p>Aussi, le recours aux PPP n\u2019est possible que si le projet remplit l\u2019une des conditions suivantes\u00a0: (i) complexit\u00e9 technique, financi\u00e8re et juridique du projet pour la personne publique, (ii) caract\u00e8re d\u2019urgence, ou (iii) bilan entre avantages et inconv\u00e9nients plus favorable que ceux d\u2019autres contrats de la commande publique.<\/p>\r\n\r\n<p>La passation d\u2019un contrat PPP ob\u00e9it \u00e0 un formalisme selon que le projet est pass\u00e9 par appel d\u2019offres, par entente directe, ou en proc\u00e9dure n\u00e9goci\u00e9e. Le l\u00e9gislateur a consacr\u00e9 la possibilit\u00e9 pour l\u2019op\u00e9rateur priv\u00e9 d\u2019adresser \u00e0 la personne publique une offre spontan\u00e9e.<\/p>\r\n\r\n<p>Dans le cadre de la n\u00e9gociation du contrat PPP avec la personne publique concern\u00e9e, l\u2019op\u00e9rateur priv\u00e9 pourra n\u00e9gocier des clauses relatives au foncier, au contenu local, aux p\u00e9nalit\u00e9s de retard en cas d\u2019inex\u00e9cution du contrat, \u00e0 la renonciation \u00e0 l\u2019immunit\u00e9 d\u2019ex\u00e9cution dont b\u00e9n\u00e9ficient les personnes publiques et m\u00eame \u00e0 la stabilisation juridique, fiscale et douani\u00e8re des conditions d\u2019exercice de ses activit\u00e9s.
